Important: Please read these Terms & Conditions carefully before using the Chute application. By creating an account or using our Services, you agree to be bound by these terms. If you do not agree, do not use Chute.

1. Acceptance of terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you") and Chute by AtoZ ("Chute", "we", "us", "our") governing your access to and use of the Chute mobile application (iOS and Android), website, and related services (collectively, "Services").

These Terms include our Privacy Policy, which is incorporated by reference. Additional policies (such as community guidelines) may apply and will be made available within the App.

For users downloading through the Apple App Store, these Terms also serve as the End User License Agreement ("EULA") as permitted by Apple's guidelines.

2. Eligibility and accounts

2.1 Age requirement

You must be at least 18 years old to create a Chute account or use our Services. By using Chute, you represent and warrant that you meet this age requirement.

2.2 Account creation

To use most features of Chute, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your information as needed.
  • Keep your login credentials (password, verification codes) secure and confidential.
  • Notify us immediately at support@chutebyatoz.com if you suspect unauthorised access to your account.
  • Be solely responsible for all activity that occurs under your account.

2.3 One account per person

You may not create more than one personal account. You may not create an account on behalf of another person without their express authorisation.

2.4 Account verification

We reserve the right to verify your identity at any time and to suspend or terminate accounts that we are unable to verify, or that we believe to be fraudulent.

3. The Services

3.1 Ride-sharing platform

Chute is a technology platform that connects riders seeking transportation with independent drivers ("Drivers") who provide transportation services. Chute is not a transportation company and does not provide transportation services. Drivers are independent contractors, not employees, agents, or partners of Chute.

3.2 Service availability

We strive to maintain continuous service availability but do not guarantee uninterrupted access. The Services may be unavailable during maintenance, updates, or due to circumstances beyond our control.

3.3 No guaranteed availability of drivers

We cannot guarantee the availability of a Driver in any specific area at any specific time. Acceptance of a ride request is at the sole discretion of each Driver.

4. Payments and fees

4.1 Fare calculation

Fares are calculated based on factors including (but not limited to) distance, estimated duration, vehicle category, time of day, and demand ("surge pricing"). A fare estimate is provided before booking, but actual fares may vary based on the trip taken.

4.2 Payment processing

All payments are processed securely through Stripe, Inc. By adding a payment method, you authorise Chute (via Stripe) to charge the applicable fare upon trip completion. Chute does not store your full payment card details.

4.3 Charges

You authorise us to charge your payment method for:

  • The trip fare (including any applicable taxes).
  • Cancellation fees (where applicable under our cancellation policy).
  • Damage fees if a Driver reports damage to their vehicle caused by a rider.
  • Any other fees described in the App at the time of booking.

4.4 Dispute of charges

If you believe you have been incorrectly charged, contact us at support@chutebyatoz.com within 30 days of the charge. We will investigate and resolve legitimate disputes in accordance with our refund policy (Section 8).

4.5 Tips

You may optionally tip Drivers after a trip is completed. Tips are sent entirely to the Driver and are non-refundable.

5. User-generated content (UGC)

5.1 Definition

"User-Generated Content" (UGC) means any content you submit, upload, post, or transmit through the Services, including in-app chat messages between riders and drivers, trip ratings, and written reviews.

5.2 Your responsibilities

You are solely responsible for your UGC and represent that:

  • You own or have the necessary rights to submit the content.
  • Your content does not violate these Terms or any applicable law.
  • Your content is accurate and does not constitute fraud, misrepresentation, or defamation.

5.3 Prohibited UGC

You must not submit content that is:

  • Harassing, abusive, threatening, hateful, discriminatory, or violent.
  • Sexually explicit, obscene, or pornographic.
  • Spam, advertising, or unsolicited commercial communications.
  • Fraudulent, false, or misleading.
  • In violation of any third party's intellectual property rights.
  • Containing malicious code, viruses, or harmful data.

5.4 Moderation and enforcement (zero-tolerance policy)

Chute has a zero-tolerance policy for abusive, harassing, or illegal content. We reserve the right to:

  • Review, remove, or modify any UGC at any time without notice.
  • Suspend or permanently ban any user who violates these content standards.
  • Report content or users to law enforcement where required by law.

5.5 Reporting abusive content

If you encounter content or behaviour that violates these Terms, you can:

  • Use the "Report" button within the App during or after a trip.
  • Block another user by tapping their profile.
  • Contact us at support@chutebyatoz.com with the subject "Safety Report".

We take all safety reports seriously and will investigate within 48 hours of receipt.

5.6 License to UGC

By submitting UGC, you grant Chute a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute your content solely for the purpose of operating and improving the Services.

6. Acceptable use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any law or regulation.
  • Impersonate another person or entity, or misrepresent your affiliation.
  • Attempt to gain unauthorised access to our systems or another user's account.
  • Use the App to transport illegal goods, substances, or engage in any unlawful activity.
  • Attempt to reverse engineer, decompile, or tamper with the App or its security features.
  • Use automated tools, bots, or scripts to access or interact with the Services.
  • Harass, threaten, or discriminate against any other user of the Services.
  • Provide false information to obtain a ride or to register as a Driver.

7. Driver obligations

Drivers using the Chute platform additionally agree to:

  • Hold all required licences, permits, and insurance to legally operate a motor vehicle for hire in their jurisdiction.
  • Maintain their vehicle in a safe, clean, and roadworthy condition at all times.
  • Complete and pass Chute's identity verification (KYC) process before accepting rides.
  • Comply with all applicable traffic laws and regulations during every trip.
  • Never drive under the influence of alcohol, drugs, or any substance that impairs driving ability.
  • Treat all riders with respect, professionalism, and without discrimination.
  • Not engage in any form of harassment, abuse, or misconduct toward riders.
  • Keep the contact information and vehicle details in their profile accurate and current.

Chute reserves the right to remove any Driver from the platform for failure to comply with these obligations, at our sole discretion.

8. Cancellations and refunds

8.1 Rider cancellations

Riders may cancel a ride request at any time before the driver arrives. A cancellation fee may apply if you cancel after a Driver has been matched and has begun travelling to your location. The specific fee (if any) will be displayed in the App at the time of cancellation.

8.2 Driver cancellations

If a Driver cancels after accepting your request, no charge will be applied. The App will automatically search for an alternative Driver.

8.3 Refunds

Refunds may be issued in the following circumstances:

  • Incorrect route taken (confirmed by GPS data) that materially increased the fare.
  • Technical error resulting in an incorrect charge.
  • Service not provided after charge was applied.

Refund requests must be submitted within 30 days of the trip date through the App (Help → Report an issue) or via support@chutebyatoz.com. Approved refunds are processed within 5–10 business days to the original payment method.

Tips are non-refundable.

9. Intellectual property

All content, features, and functionality of the Chute App and website — including but not limited to the Chute name, logo, design, software, text, graphics, and data — are the exclusive property of Chute by AtoZ and are protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the App for your personal, non-commercial purposes, strictly in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of our Services without our prior written consent.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHUTE DISCLAIMS ALL WARRANTIES INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.
  • WARRANTIES REGARDING THE CONDUCT, ACTS, OR OMISSIONS OF DRIVERS OR OTHER USERS.

Chute does not guarantee the quality, suitability, safety, or ability of any Driver. Riders use the Services and take rides entirely at their own risk.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHUTE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM:

  • Your access to or use of (or inability to access or use) the Services.
  • Any conduct or content of any third party, including Drivers, on or relating to the Services.
  • Any trip or service provided by a Driver through the Chute platform.
  • Unauthorised access to or alteration of your transmissions or data.

IN NO EVENT SHALL CHUTE'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU TO CHUTE IN THE 12-MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100.

12. Termination

We reserve the right to suspend or terminate your account and access to the Services, at our sole discretion, without notice or liability, for any reason including but not limited to:

  • Violation of these Terms.
  • Fraudulent, abusive, or illegal conduct.
  • Prolonged inactivity.
  • Requests from law enforcement or regulatory authorities.

You may terminate your account at any time by following the process in Section 7 of our Privacy Policy or by contacting us at support@chutebyatoz.com.

Upon termination, the following provisions shall survive: Sections 4 (outstanding payments), 6, 9, 10, 11, and 13.

13. Governing law and dispute resolution

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from or related to these Terms or the Services shall first be addressed by contacting our support team at support@chutebyatoz.com. We are committed to resolving disputes promptly and fairly.

Nothing in these Terms limits your rights as a consumer under applicable mandatory consumer protection laws.

14. Changes to these terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

  • Update the "Last updated" date at the top of this page.
  • Send an in-app notification or email to registered users at least 7 days before the changes take effect.

Continued use of the Services after the effective date of the changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Services and may request account deletion.
